Privacy policy of SYMPHONIC Trading GmbH 

Protecting your personal data is very important to us. That is why we only process your data based on the legal provisions (GDPR, Telecommunications Act 2003). In the following data protection information, you can find information about the most important aspects of data processing related to our website.

 

General information

1. The following applies to prospective customers, business partners, customers and suppliers

We store the data from you that is required for mutual contract fulfilment. This concerns the following data categories: Customer or supplier master data, name and contact data of your employees, contractual data or data you send to us by email, for example. We delete the data as soon as saving it is no longer required or legal storage obligations, such as for value added tax law purposes, have expired. 

Except in legally prescribed cases, data is only transferred to third parties after you provide your consent or to contractually bound order processors. Legal basis: Art. 6 para. 1 lit b, c, f; when obtaining consents Art. 6 para. 1 lit a GDPR.

4. Revocation of your consent to data processing

Many data processing processes are only possible with your express consent. You can revoke a granted consent at any time. All you need to do for this purpose is send us an email to datenschutz@symphonic.at. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

 

5. SSL or TLS encryption

This site uses an SSL or TLS encryption for safety reasons and to protect the transmission of confidential content, such as orders or inquiries, which you send us as the site operator. You can identify an encrypted connection by the fact that the address bar in the browser changes from “http://” to “https://” and by the lock symbol in your browser bar. If the SSL or TLS encryption is enabled, the data that you send to us cannot be read by third parties.

 

6. Objection to advertising email

The use of contact data published as part of the imprint obligation to send advertising and informational materials not expressly requested is hereby rejected. Data collection on our website

1. Cookies

Our websites use cookies. Cookies do not damage your computer and do not contain viruses. These are used to make our website more user-friendly, effective and safer. Cookies are small text files that are filed on your end device and stored by your browser.

 

1.1 Transient cookies

Transient cookies are automatically deleted when you close the browser. These in particular include session cookies. These store a session ID, which can be used to assign various requests from your browser to the joint session. This means your computer can be recognised when you return to our website. The session cookies are deleted when you log out or close the browser.

 

1.2 Persistent cookies

Persistent cookies are automatically deleted after a specified duration, which may vary depending on the cookie. You can delete the cookies in your browser’s security settings at any time.

 

1.3 Browser settings

You can configure your browser settings as you desire and, for example, reject the acceptance of third party cookies or all cookies. If cookies are deactivated, the functionality of our website may be limited. Cookies, which are required to perform electronic communication or to provide certain functions you desire (e.g. shopping cart function, wish list ) are stored based on article 6 (1) lit. f GDPR.

 

2. Using the website for informational purposes

When using the website purely for informational purposes, we only collect personal data that your browser sends to our server. If you would like to view our website, at most we collect the data that we technically required to show you our website and to ensure stability and security (legal basis is art. 6 para. 1 lit. f GDPR):

3. Contact form

To contact Symphonic, the user can use the contact form. Symphonic needs the following information so you can use the contact form:

•    Email address

•    First name

•    Surname

•    Issue

•    Your message

Users can give Symphonic other information, but they do not need to. Symphonic uses the user data to answer the request and to send the desired informational material. If necessary, the information sent to Symphonic is forwarded to the competent body responsible for the user’s request. The data entered by the user is transmitted via a secured SSL connection. Once processing is finished, the user data are deleted no later than within 13 months, however, provided a longer storage is not required for reasons of verifiability, customer support or statutory retention periods.

 

4. Newsletter

Symphonic processes the data specified by the user for the purpose of direct advertising when the user signs up for the newsletter. This means that the user will be contacted and informed by email via the newsletter in a personalised way if Symphonic believes based on the data that information about offers, services and events of Symphonic are specifically relevant and of interest for the user. The consent to be sent the newsletter can be revoked at any time.

 

5. Google services

The following services of Google reCaptcha and Google Fonts are a service provided by Google Ireland Limited (“Google”), a company registered and operated under Irish law (register number: 368047) with its head office at Gordon House, Barrow Street, Dublin 4, Ireland (“Google”).

 

5.1 Google Analytics

We use Google Analytics, a web analysis service of Google. The website operator has a legitimate interest in analysing user behaviour in order to optimise its website as well as its advertising.

 

5.2 IP anonymisation 

We have enabled the IP anonymisation feature on our website. This means your IP address is truncated by Google within member states of the European Union or in other contract state of the Address before being transmitted to the US. Only in exceptional cases, your complete IP address is transmitted to a Google server in the USA and shortened there. Google will use this information on behalf of the operator of our website for the purposes of evaluating your use of the website, compiling reports on website activities, and providing other services to the website operator relating to website activity and Internet usage. Google will not associate your IP address with any other data held by Google.

5.2.2 Order data processing

We have concluded a contract with Google for order data processing and are fully implementing the strict requirements of the Austrian data protection authorities regarding the use of Google Analytics.

 

5.2.3 Demographic characteristics with Google Analytics

Our website uses the “demographic characteristics” function of Google Analytics. This means reports can be generated containing information about the age, gender and interests of site visitors. These data come from interest-related advertising by Google as well as visitor data from third party providers. These data cannot be assigned to any certain person. You can always disable this function via the display settings in your Google account or generally prohibit the collection of your data by Google Analytics as shown in the point “Objection to data collection”.

 

5.3 Use of Google AdSense

Our website uses Google AdSense to integrate advertisements. Google AdSense uses cookies. These are files that are stored on your PC and allow Google to analyse the data of your use of our website. In addition, web beacons are also used with Google AdSense, which are invisible graphics that allow Google to analyse clicks on this website, the traffic on this website and similar information. The information obtained via cookies and web beacons, your IP address as well as the delivery of advertisement formats are sent to a Google server located in the US and stored there. Google may pass on this collected information to third parties if this is legally required or Google commissions third parties with the data processing. However, Google will combine your IP address together with the other stored data. With the appropriate settings on your Internet browser, you can prevent the aforementioned cookies from being saved on your PC. However, it is possible then that the content of our website can no longer be used to the full extent. By using our website, you agree to Google processing the data collected about you in the manner described above and for the aforementioned purpose.

 

5.4 Use of Google Maps

Our website uses Google Maps to show map information. When using Google Maps, Google also processes and uses data about the use of the Maps function by visitors to the websites. You can also change your settings there in the data protection centre so that you can manage and protect your data.

 

5.5 Use of Google Fonts

Our website uses external fonts, Google Fonts. Google Fonts is a service of Google Inc. Web fonts are incorporated through a service call-up, which is usually a Google server in the US. Communication is hereby transmitted to the  server that indicates which of our web pages you have visited. You can also change your settings there in the data protection centre so that you can manage and protect your data.

 

5.6 Use of Google recaptcha

We use the Google service reCaptcha to determine whether a person or a computer is making a certain entry in our contact or newsletter form. Google uses the following data to check whether you are a person or a computer: IP address of the end device used, our web page that you are visiting and on which the Captcha is incorporated, the date and duration of the visit, the recognition data of the browser and operating system type used, Google account if you are logged into Google, mouse movements on the reCaptcha surfaces, as well as tasks that require you to identify images. The legal basis for the described data processing is Article 6 (1) sentence 1 f GDPR. We have a legitimate interest in this data processing to guarantee the security of our website and to protect ourselves from automated entries (attacks).

 

6. Plug-ins and tools

6.1 YouTube

We have integrated YouTube videos in our online offering, which are stored at http://www.YouTube.com and can be played directly from our website. This is a social media service provided by “Google” (Barrow Street, Dublin 4, Ireland). These are all integrated in the “extended data protection mode,” which means that no data about you as the user is sent to YouTube if you do not play the videos. The data mentioned in the following will only be transmitted when you play the videos. We have no influence over this data transmission.

 

By visiting the website, YouTube receives the information that you have called up the corresponding sub-page on our website. This occurs regardless of whether YouTube provides a user account that you are logged into or whether there is no user account. If you are logged into Google, your data is assigned directly to your account. If you do not want the allocation with your YouTube profile, you must log out before activating the button. YouTube stores your data as usage profiles and uses them for purposes of advertising, market research and/or customized design of their website. Such an evaluation is carried out in particular (even for users who are not logged in) for the provision of need-based advertising and to inform other users of the social network about your activities on our website. You have a right to object to the formation of these user profiles, and must contact YouTube to exercise that right.

6.2 Facebook

Our website relies on the services of Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, D 2 Dublin, Ireland (in short: "Facebook”) for the information or posts linked here or provided on Facebook. For this purpose, we use social plug-ins from Facebook, which can be identified by one of the Facebook logos (“f” on the corresponding background, the “thumbs up” sign or the term “Like”) or are labelled by the addition “Facebook Social Plug-in”. When a user calls up visit a web page that contains such a plug-in, said user's browser establishes a direct connection with the servers of Facebook. The content of the plug-in is transmitted from Facebook directly to your browser and is embedded in the page by this browser. We therefore have no influence on the scope of the data that Facebook collects using this plug-in and inform you as follows:

 

The data collected in this way is anonymous for us, which means we do not see the personal data of individual users. However, Facebook saves and processes these data. You can allow Facebook and its partners to display advertisements on and off of Facebook. Furthermore, a cookie can be saved on your computer for these purposes.

6.3 Instagram

This may include content such as images, videos or text and buttons that users can use to react to content. 6.4 Pinterest

Content and functions of the service Pinterest can be integrated on our website. They are offered by Pinterest Inc., 635 High street, Palo Alto, CA, 94301, USA. If users are members of Pinterest, calling up the content and functions can be associated with the user’s respective profile. 6.5 XING

The "XING Share button” is used on this website. When accessing this website, your browser makes a brief connection to servers of XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany (“XING”), which allow the "XING Share button” functions to work (in particular the calculation/display of the meter value). XING does not store any personal data about you accessing this website. XING in particular does not store any IP addresses. 6.6 LinkedIn

On our website, we use functions of the service Linked in from the company LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Calling up pages that use functions like these will send data (IP address, browser data, date and time, cookies) to LinkedIn, which will save and evaluate them. If you have a LinkedIn account and are logged in, these data will be assigned to your personal account and the data stored there. 6.7 Vimeo

Our website has integrated plug-ins of the video portal Vimeo from Vimeo, LLC, 555 West 18th Street, New York, New York 10011, USA. Every time you access a page offering one or more Vimeo video clips, a direct connection is established between your browser and a Vimeo server in the US. Information about your visit and your IP address are stored there. Through interactions with the Vimeo plug-ins (e.g. clicking on the start button), this information is also sent to Vimeo and stored there. If you have a Vimeo user account and do not want Vimeo to collect data about you and link it to your member data stored by Vimeo via our website, you must log out of Vimeo before visiting this website.

 

In addition, Vimeo uses an iFrame to call up the tracker Google Analytics. The video is called up in the iFrame. This is Vimeo's own tracking to which we have no access. 6.8 Adobe Typekit

Our site uses web fonts provided by Adobe to achieve a uniform representation of fonts. When accessing a page, your browser loads the required web fonts into its browser cache to correctly display texts and fonts. For this purpose, the browser you use must connect to the Adobe servers. Adobe gains knowledge here that our website was called up via your IP address. Adobe Typekit is used in the interest of a uniform and appealing representation of our online offers. This is a legitimate interest in the sense of article 6 para. 1 lit. f GDPR. If your browser does not support web fonts, a standard font will be used by your computer. 7. Participation in the online sweepstakes

If you participate in sweepstakes on our website or our social media channels, we will process the following personal data in this context:

•    Email address and/or telephone number

•    Salutation

•    Name and surname

•    Sweepstakes-dependent information (agreement to terms of participation, etc., consent to process the data for marketing purposes, time of participation)

•    Data that are processed in the context of the survey about our services (your relationship with SYMPHONIC Trading GmbH, related products, living situation, gender, age, profession, postal code)

 

7.1 Basis of data processing

By participating in the sweepstakes, we conclude a so-called luck contract with you. The legal basis for processing the data is art. 6 para. 1 lit b GDPR and thus the processing to fulfil a contract and our legitimate interest as per art. 6 para. 1 lit f GDPR. If you do not provide us with the data, we cannot meet our contractual obligations. You can therefore not participate in the sweepstakes.

 

7.2 Data storage

All participant data are deleted no later than 3 years from the end of the sweepstakes (§1489 ABGB). The data of the winners are stored for the duration of the statutory retention periods, in particular the Federal Fiscal Code. Therefore after 10 years after the expiration of the year in which the sweepstakes take place, the data will be deleted.

 

7.3 Rights of parties concerned

We would like to inform you that you always have the right to request information about which of your data we are processing (for details, see art. 15 GDPR), the right to have your data corrected or deleted (for details, see art. 16 GPDR), the right to restrict the processing of your data (for details, see art. 18 GDPR), the right to object to the data processing (for details, see art. 21 GPDR), as well as the right to data transferability (for details, see art. 20, GDPR).

7.4 Participation in Facebook sweepstakes

Natural persons aged 18 and older may participate. All persons who perform the required action (usually a comment on Facebook) as part of the sweepstakes in the specified time period will participate in the drawing. The winners will be determined at random within 7 days from the end of the sweepstakes. The winners will be informed via private message on Facebook. If a winner does not get in touch, no prize will be sent.

 

The party responsible for the sweepstakes reserves the right to cancel the sweepstakes in justified cases, to postpone the determination of the prize or to change the rules of the game without specifying the reasons. No written or verbal information about the course of the sweepstakes can be provided. This does not impair your right to information in the sense of art. 15 GDPR. The prizes cannot be redeemed in cash. A legal process is excluded.

 

The sweepstakes are in no way associated with Facebook and are not sponsored, supported or organised by Facebook in any way. All questions, comments or complaints about the sweepstakes are to be sent exclusively to Symphonic Trading GmbH and not to Facebook.

 

Changes to this privacy policy

We reserve the right to make adjustments to our privacy policy from time to time. We will not restrict your rights to this privacy policy without your express consent. We will publish all changes to the privacy policy we make on this page. Please note the current version of our privacy policy in this regard. 

Mouse tracking

We are concerned with improving our offer and our website in the sense of GDPR (legitimate interest). That is why we use Hotjar to better understand our users’ needs and to optimise the offer on this website. Hotjar’s technology gives us a better understanding of our users’ experiences (such as how much time users spend on which pages, which links they click on, what they like and what they don't like, etc.) and helps us to align our offer with our users’ feedback. Hotjar works with cookies (see above) and other technologies to collect information about the behaviour of our users and about their end devices (in particular the device IP address (only collected and saved in anonymised form)), screen size, device type (unique device identifier), information about the browser used, location (only country), preferred language for displaying our website). Hotjar saves this information in a pseudonymised user profile. The information is not used by Hotjar or by us to identify individual users nor is it combined with other data about individual users.
